Evicting tenants can be a complicated. It is always sensible to contact a solicitor before attempting to evict your tenant to ensure the specified procedures are followed, as unlawful eviction is a criminal offence.

The first stage of the process will usually involve serving a notice on the tenant under either Section 21 or Section 8 of the Housing Act, depending on your particular circumstances. The notice must be in the right legal format and should state the correct expiry date. If not, the notice could be found invalid by a Court and you would need to start the process again.

If a tenant does not leave the property by the required expiry date of the notice, the next stage of the process would involve an application to the Court for a possession order. We would be able to make this application on your behalf, drafting the court documents for you and representing you at Court, should a hearing become necessary.
