How our Talbot Green Divorce lawyers can help you
Commencing divorce proceedings
If you wish to commence a divorce, we will advise you on the process and ensure that your application is accurate and contains all necessary details. It is important not to make any errors in your application to the court to avoid delays or rejection of your application.
Other issues will also need to be addressed, usually before the divorce is finalised, such as arrangements for children and financial issues. We will advise you in respect of these to ensure that you do not miss the opportunity to put the right legal agreements in place.
Responding to divorce proceedings
If divorce proceedings are served on you, you will be required to sign and complete an Acknowledgement of Service form and send it back to the court. This is your opportunity to say whether or not you wish to defend the divorce proceedings. You will also be asked whether you agree to the reasons cited for the divorce.
If both parties are in agreement about the divorce, a decree nisi can be requested by the person who commenced the proceedings. This will be followed six weeks later by a decree absolute finalising the divorce.
Financial settlements in divorce
Financial matters are normally settled before the divorce is finalised. This process can be complicated and may be disputed as arrangements are made to separate your finances.
Our divorce solicitors in Talbot Green are experts in the financial aspects of divorce, including in complex and high-value cases. We can work with you to try to reach a voluntary divorce settlement. If this is not possible, we can apply to the court on your behalf to request a financial order.
Arrangements for children following divorce
For many people, their main concern in a divorce or separation is when they will see their children, how often and for how long. We can help you negotiate the arrangements for your children and ensure that their best interests are prioritised. We can also discuss mediation with you if this is likely to help.
Any agreement you make voluntarily can be made legally binding with an application to a court where required. If an amicable agreement cannot be reached, we can assist with applying to a court for a Child Arrangements Order to decide where your children will live etc.
Our family law team understand how difficult it is to deal with child contact issues. We will stay by your side throughout negotiations to support and represent you and make sure that you always have the advice and guidance that you need.
