We know how important compensation can be for everything from helping you pay for treatment you require and replacing lost income while you recover from your injuries to funding support, equipment and other essentials you need to cope with any lasting effects from your injuries.

We take on many of our clients on a No Win, No Fee basis, meaning everyone can have access to the legal help they need to achieve fair compensation for their injuries. We will explain all of the available options, including negotiation and court action, advising you on the most appropriate way to proceed so you can get the compensation you deserve quickly and cost-effectively with the minimum stress.

Common questions about personal injury claims

How do I claim for personal injury compensation?

The process starts with our solicitors sending a claim letter to the person or organisation you hold responsible for your injury. This letter will detail the specifics of your injury and how it occurred. The recipient will normally have up to 3 months to respond to the letter, although the time limit may be shorter, depending on the circumstances.

Where the defendant accepts liability for your injury, we will seek to negotiate a fair compensation settlement with them. Where they do not accept responsibility, or if it is not possible to negotiate an acceptable settlement, we will usually then apply to a court for a resolution.

You will be given a court date where we will represent you and the defendant will be able to put across their argument for why they feel they are not liable. The court will then decide if you are entitled to compensation and, if so, how much this should be.

What is the time limit for making a personal injury claim?

Generally, you have up to 3 years from the time of an injury to start a compensation claim. The exact time limit may vary, however, depending on the circumstances, so it is a good idea to consult an expert personal injury lawyer at the earliest opportunity to ensure you do not miss out.

How long does it take to get compensation for a personal injury?

The amount of time it takes to resolve a personal injury claim can vary significantly, depending on the circumstances and whether the defendant accepts liability and is willing to quickly negotiate a settlement. If the defendant does not accept liability, it can take months or even (in rare circumstances) years to achieve a resolution.

Fortunately, for many personal injury claims there is an option that can allow them to be resolved relatively quickly. The Ministry of Justice’s streamlined settlement process can be used for Road Traffic Accidents, employer’s liability cases and public liability cases valued between £1,000-£25,000. This means relatively straightforward cases can often be resolved in around 4-9 months.

We appreciate that knowing how long your claim is likely to take is an important factor for many people pursuing personal injury compensation. We will, therefore, make sure to give you a realistic timescale at the outset and keep you informed at every stage of the claims process, so you have a clear picture of how things are progressing.
